摘要
罢工是劳资冲突的极端形式。本文在梳理各种罢工理论的基础上，分析了我国现阶段罢工的性质、原因和特点，以及罢工在改善工人生存状况方面的作用，运用劳资谈判模型分析了存在罢工权立法与不存在罢工权立法的罢工者成本。结论是：为平衡劳资关系，构建社会主义和谐社会，应当根据我国现阶段劳资关系的实际状况，适时推进罢工权立法，这是一项帕累托改进。
